Terms and Conditions of the RAF-MAR Fishing Online Store

§1 General Provisions

  1. The RAF-MAR Fishing online store, available at www.rafmar-fishing.pl, is operated by:

  1. These Terms and Conditions set out the rules for using the online store, placing orders, concluding and performing sales contracts, as well as the rights and obligations of Customers and the Seller.
  2. The Store provides mail-order sales within Poland and to selected European Union countries, according to the delivery methods currently available during the checkout process.
  3. Placing an order requires the Customer to read and accept these Terms and Conditions.
  4. Products offered in the Store have been legally placed on the market and have the properties specified in their descriptions.

§2 Placing Orders

  1. Orders may be placed through the Store website 24 hours a day, 7 days a week.
  2. After placing an order, the Customer receives an automatic confirmation that the order has been received.
  3. The sales contract is concluded when the Seller confirms the Customer's order.
  4. The Customer is required to provide accurate contact details and a valid delivery address.
  5. The Store reserves the right to verify an order or refuse to process it in justified cases, including product unavailability, incorrect Customer details or outstanding payments.

§3 Prices and Payment Methods

  1. Product prices displayed in the Store are gross prices and include applicable VAT.
  2. Prices may be displayed in Polish zloty (PLN) or in other currencies made available in the Store, in particular euro (EUR). The currency and final amount payable are shown to the Customer before the order is placed.
  3. Product prices do not include delivery costs unless explicitly stated otherwise. The delivery cost is shown to the Customer before the order is placed.
  4. Available payment methods may include in particular:
  • traditional bank transfer to the Seller's bank account,
  • online payments via Sky-Pay / Autopay,
  • BLIK,
  • payment by debit or credit card,
  • Apple Pay and Google Pay, where such methods have been activated and are available for the selected currency,
  • cash on delivery,
  • cash payment upon personal collection.
  1. The availability of particular payment methods may depend on the country of delivery, order currency and selected delivery method. Payment methods currently available for a particular order are displayed during the checkout process.
  2. Online card payment services are provided by Autopay S.A.
  3. Available card payment methods include in particular:
  • Visa,
  • Visa Electron,
  • Mastercard,
  • Mastercard Electronic,
  • Maestro.
  1. In the case of a traditional bank transfer, order processing begins after the payment has been credited to the Seller's bank account, unless the Seller informs the Customer that processing has started earlier.
  2. In the case of card payments or other electronic payments, order processing begins after the Seller receives confirmation of successful payment authorisation.

§4 Delivery

  1. Orders are delivered by courier companies or other delivery operators available during the checkout process, according to the Customer's selection.
  2. The standard order processing time is between 1 and 5 business days, calculated from the date the order is confirmed or, where advance payment is required, from the date the payment is credited or successfully authorised.
  3. Products are delivered to the address provided by the Customer.
  4. Delivery costs are provided on the Store's delivery information page and during the checkout process.
  5. The Customer should check the condition of the parcel upon delivery. In the event of visible damage, it is recommended that a damage report be prepared in the presence of the courier.

§5 Right of Withdrawal

  1. A Consumer who has concluded a distance contract has the right to withdraw from it without giving any reason within 14 days, subject to exceptions provided for by applicable law.
  2. In the case of a contract for the sale of goods, the withdrawal period begins on the day on which the Consumer, or a third party designated by the Consumer other than the carrier, takes possession of the goods.
  3. To exercise the right of withdrawal, the Consumer should inform the Seller of their decision by means of an unequivocal statement, in particular by e-mail sent to hurt@rafmar-fishing.pl or in writing to the Seller's registered address.
  4. The Consumer must return the goods to the Seller without undue delay and no later than 14 days from the date on which the Consumer withdrew from the contract. The deadline is met if the goods are dispatched before the 14-day period expires.
  5. The Consumer bears the direct cost of returning the goods unless the Seller has agreed to bear such cost or applicable law provides otherwise.
  6. The Consumer is liable for any reduction in the value of the goods resulting from handling them in a manner beyond what is necessary to establish their nature, characteristics and functioning.
  7. The Seller shall refund all payments received from the Consumer that are subject to reimbursement, including the cost of the least expensive standard delivery method offered by the Seller, without undue delay and no later than 14 days from the date on which the Seller receives the Consumer's statement of withdrawal.
  8. The Seller may withhold the refund until the returned goods are received or until the Consumer provides proof that the goods have been sent back, whichever occurs first.
  9. Refunds are made using the same payment method that the Consumer used for the original transaction, unless the Consumer has expressly agreed to another refund method that does not result in any additional costs. In the case of card payments, refunds are processed using the refund mechanism applicable to the original card transaction.
  10. If the Consumer has selected a delivery method other than the least expensive standard delivery method offered by the Seller, the Seller is not required to reimburse the additional delivery costs resulting from that choice.
  11. The right of withdrawal does not apply in cases specified by applicable consumer law, including in particular goods that are not prefabricated and have been manufactured according to the Consumer's specifications or are clearly personalised.

§6 Complaints and Warranties

  1. The Seller is obliged to deliver goods that conform to the sales contract.
  2. If the goods do not conform to the contract, the Customer has the right to submit a complaint in accordance with applicable law.
  3. Complaints may be submitted by e-mail to hurt@rafmar-fishing.pl or in writing to the Seller's registered address.
  4. The Store considers complaints within 14 calendar days of receiving them and informs the Customer of the outcome.
  5. Where a complaint is justified, the Customer is entitled to the remedies provided for by applicable law, including repair or replacement of the goods and, where the relevant legal requirements are met, a price reduction or withdrawal from the contract.
  6. Products may additionally be covered by a manufacturer's warranty where such a warranty has been provided. A manufacturer's warranty does not exclude, restrict or suspend the Customer's statutory rights against the Seller.

§7 Personal Data Protection

  1. The controller of Customers' personal data is RAF-MAR S.C.
  2. Personal data is processed for purposes including order fulfilment, issuing invoices and conducting correspondence related to the sales contract, in accordance with applicable data protection legislation, including the GDPR.
  3. Customers have the rights provided for by applicable data protection law, including the right to access their personal data, rectify it, request its deletion or restrict its processing.
  4. Detailed information concerning the processing of personal data is provided in the Store's Privacy Policy.

§8 Final Provisions

  1. Matters not regulated by these Terms and Conditions are governed by applicable Polish law, in particular the Polish Civil Code and the Polish Consumer Rights Act, as well as applicable European Union law.
  2. These Terms and Conditions are continuously available on the Store's website in a form that allows Customers to access and save their contents.
  3. The Store reserves the right to amend these Terms and Conditions. Orders placed before an amendment enters into force are governed by the version of the Terms and Conditions applicable on the date the order was placed.
